UPDATE - Berkshire's has confidential treatment related to his stakes in Norfolk Southern Corp. (NYSE: NSC) and Union Pacific (NYSE: UNP). In last quarter's 13F Buffet showed a 6,362,800 share stake in NSC and 10,513,100 shares stake in UNP.

Just curious – I'm assuming the information on the two railroads (Union Pacific and Norfolk Southern) is confidential and that Berkshire has simply omitted them from the filing rather than having actually sold those stakes? Do you know if this is true?

I see it being reported like that from other media outlets.

If he still has confidential treatment then why did he have to disclose the stakes in last quarter's filing?

In the amend 13F filing on 5/15 that disclosed the rail stakes, it said confidential treatment expired on May 15, 2007.

All I have to go on is this quick note in the report summary which reads:

"Confidential Information has been omitted from the public Form 13F and filed separately with the Commission. Included in this information is information regarding Berkshire's positions in Norfolk Southern Corp. and Union Pacific Corp. included in its March 31, 2007 public Form 13F."

I'm no lawyer, but I guess if your Buffett you can get confidential treatment more than once on the same position.
